Terms and Conditions of Sale

These Terms and Conditions of Sale (hereinafter the "T&Cs") govern the contractual relationship between [RAISON SOCIALE] (hereinafter the "Seller") and any natural or legal person wishing to make a purchase on the Magie de Noël website (hereinafter the "Buyer" or the "Customer").

Any order implies unreserved acceptance of these T&Cs.

1. Products and services

The products offered are those featured in the catalogue published on the website. Catalogue photographs are not contractual. The Seller reserves the right to modify the composition of the catalogue at any time.

All products are offered while stocks last. If a product is unavailable, the Customer will be informed at the latest when their order is confirmed. No late-payment penalty shall be due in the event of a stock shortage noted after the order.

2. Prices

The prices of our products are shown in euros inclusive of all taxes (VAT included), excluding shipping costs.

The applicable VAT is that in force on the day of the order. The Seller reserves the right to change its prices at any time but undertakes to apply the rates in force at the time the order is confirmed.

Delivery costs are calculated according to the weight, volume and destination of the order. They are shown before the order is finally confirmed.

Free delivery from 49€ of purchase (mainland France only).

3. Ordering

The Customer places an order on the website by following the online purchase process:

1. Selecting products and adding them to the cart
2. Validating the cart and accessing the checkout
3. Identification or creation of a customer account
4. Choosing the delivery address
5. Choosing the delivery method and calculating shipping costs
6. Choosing the payment method
7. Reviewing the order summary and accepting the T&Cs
8. Payment and final confirmation

An order confirmation email is sent to the Customer as soon as possible. The sale will only be considered final once payment has been received.

4. Payment

Payment is made online securely by:

• Bank card: Visa, Mastercard, American Express (via Stripe)
• PayPal
• Interest-free payment in 3 instalments: available for any order over 50€ (subject to acceptance by our payment partner)

Banking transactions are secured by our approved payment partners. The Seller does not store any banking data on its servers.

5. Delivery

Products are delivered to the address indicated by the Customer when placing the order.

Delivery times (mainland France):

• Colissimo: 2 to 4 business days
• Chronopost: 1 to 2 business days
• Pickup point: 3 to 5 business days

The times indicated are provided for guidance only. The Seller cannot be held liable for delivery delays caused by the carrier or by an event of force majeure.

In the event of a delivery delay exceeding 30 days, the Customer may request cancellation of their order and a full refund of the amounts paid.

6. Right of withdrawal (14 days)

In accordance with article L.221-18 of the French Consumer Code, the Customer has a period of 14 clear days from receipt of their order to exercise their right of withdrawal, without having to give a reason or pay a penalty.

To exercise this right, the Customer must notify the Seller of their decision by email at contact@magie-noel.fr or via their customer account.

Products must be returned in their original packaging, in perfect resale condition (unused, unwashed, with tags).

Free returns: the Seller covers the return shipping costs (prepaid label provided on request).

The refund will be made within 14 days of receipt of the returned parcel, using the same payment method as the one used for the order.

7. Legal warranties

All products benefit from the legal warranties provided for by the French Consumer Code:

• Warranty of conformity (article L.217-4): 2 years from delivery of the goods
• Warranty against hidden defects (article 1641 of the Civil Code): 2 years from discovery of the defect

In the event of a lack of conformity, the Customer may request the repair or replacement of the product, or failing that a price reduction or cancellation of the sale with a refund.

Certain products may benefit from an additional manufacturer's commercial warranty (details on the product page).

8. Liability

The Seller cannot be held liable for non-performance of the contract in the event of force majeure, or total or partial disruption or strike of postal services and means of transport.

The photographs and graphics presented on the website are not contractual and cannot engage the Seller's liability.

9. Protection of personal data

In accordance with the GDPR, the personal data collected when ordering is necessary for the processing and delivery of orders.

10. Mediation and disputes

In the event of a dispute and after any attempt to find an amicable solution has failed, the consumer Customer may use the MEDICYS mediation service free of charge.

Failing an amicable settlement, the dispute will be brought before the competent French courts.

11. Applicable law

These T&Cs are governed by French law. They are written in French. Should they be translated into one or more languages, only the French text shall prevail in the event of a dispute.
